Terms of Use

We want everyone to enjoy using Launchpad! To ensure a smooth and positive experience, we’ve outlined some important terms below. Please take the time to review them to avoid any misunderstandings.

These Terms of Use are effective from 1 January 2024.

The following document outlines Launchpad’s terms of use. You can also review our Privacy Policy, which outlines how we handle your personal information in line with the Privacy Act 2020 of New Zealand and other applicable data protection laws.

In these terms, “Launchpad”, “we”, “our” or “us” refers to Life101 Limited, the company behind the Launchpad programme.

1. Acceptance of Terms

1.1 You are only allowed to access and use Launchpad’s services (the “Service”) if:

  • You have read, understood, and agreed to these Terms of Use, along with our Privacy Policy (collectively referred to as the “Agreement”); or
  • If you are under 18, you confirm that your parent or guardian has read, understood, and agreed to the Agreement on your behalf before using the Service.

1.2 By using the Service, you consent to the terms of this Agreement. If your school or organisation has invited you to access Launchpad, your use may also be subject to their terms.

1.3 If you do not agree to these terms, you must stop using the Service immediately.

2. Amendments to the Terms

2.1 We may update these terms from time to time by posting the changes on our Website. Any changes will be effective immediately upon posting. It’s your responsibility to review the latest version of this Agreement regularly. Your continued use of the Service signifies your acceptance of the updated terms.

2.2 Any disputes that arise will be governed by the terms in effect at the time of the dispute.

3. Access and Use

3.1 You may only use the Service for its intended purpose of providing life and financial skills education.

3.2 We grant you permission to use the Service for 180 days (from account creation) as long as you comply with these terms. We may modify, suspend, or discontinue the Service or any part of it at any time, without notice or liability.

3.3 By agreeing to these terms through the tick box at account creation, you confirm that:

  • You are of legal age to enter into a contract, or if you are under 18, you confirm that your parent or guardian has agreed to the terms on your behalf by reviewing and consenting to the Privacy Policy and Terms of Use; and
  • The information you provide when registering is accurate and truthful. You also agree to keep all information current throughout the time that you use the Service.

3.4 If you are using Launchpad on behalf of an organisation (like a school), you confirm that you are authorised to bind that organisation to this Agreement.

3.5 If you are under 18 and have confirmed that your parent or guardian has given consent, “you” in this Agreement applies to the child, with the understanding that the parent or guardian has provided consent.

4. Registration

4.1 Users: If you’re using Launchpad at the invitation of a school or organisation, you agree not to use the Service unless invited to do so.

  • If you are under 18, you must have your parent or guardian’s consent to use Launchpad.

4.2 Administrators: If you are using Launchpad as an administrator on behalf of an organisation (ie. a school), you confirm you are authorised to do so and will not allow unauthorised individuals to access the Service.

4.3 Private Users: If you are accessing Launchpad for personal use, you agree not to allow anyone under 18 to use the service unless they have received proper consent from a parent or guardian.

5. Pricing

5.1 Access to Launchpad may be subject to fees. For details on pricing, please refer to pricing information provided on www.101launchpad.co.nz.

  • Our liability to you in respect of the Service is limited to the maximum extent permitted by law, including under the Consumer Guarantees Act 1993 (CGA). Payment of fees does not affect any rights you may have under the CGA, and nothing in these terms excludes or limits those guarantees beyond what the law allows.

5.2 All fees are inclusive of applicable taxes, including Goods and Services Tax (GST), unless otherwise stated. You are responsible for any applicable taxes or third-party charges related to your use of the Service.

6. Content and Intellectual Property

6.1 The content within the Service, including but not limited to text, graphics, and software, is intended solely for educational use and does not constitute financial advice in any form.

6.2 All intellectual property rights in the Service belong to Launchpad or our licensors. You may not copy, reproduce, or exploit any part of the Service without our prior written consent.

6.3 If you provide feedback, suggestions, or testimonials to us, you agree that we can use that feedback for any purpose without restriction or compensation to you. If we would like to use your name, we will request your consent beforehand and will not use your name or personal information without your consent.

7. User Data and Privacy

7.1 By using Launchpad, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal data in accordance with the Privacy Act 2020.

7.2 Any content or data you provide to us through the Service is subject to the Privacy Policy and applicable laws. You grant us permission to use your data as outlined in the Privacy Policy.

7.3 We comply with the Notifiable Privacy Breach requirements under the Privacy Act 2020 and will notify you and the Office of the Privacy Commissioner (OPC) in the event of a serious privacy breach.

  • Users must notify Launchpad of any suspected data breaches on their end to ensure they take responsibility for reporting security issues.
8. Your Responsibilities

8.1 You agree not to:

  • Use the Service for any unlawful purposes;
  • Violate the rights of others, including privacy and intellectual property rights;
  • Interfere with the security or functionality of the Service.
9. Indemnity and Limitation of Liability

9.1 You agree to indemnify and hold Launchpad harmless from any claims, damages, liabilities, and expenses arising out of your use or misuse of the Service or violation of these terms, to the fullest extent permitted by law.

9.2 Launchpad is provided “as is” without warranties of any kind. We do not guarantee that the Service will be error-free, uninterrupted, or free from harmful components. To the fullest extent permitted by law, we disclaim any warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.3 Launchpad is not liable for content found in third-party links or resources that may be accessible through the service.

9.4 In no event will Launchpad or its directors, officers, or employees be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.

9.5 Our total liability for any claims relating to the Service is limited to the amount you have paid us for the use of the Service.

10. Termination

10.1 We may terminate or suspend your access to the Service at any time for any reason, including if we believe you have violated these terms.

10.2 Upon termination, your right to use the Service will cease immediately, and any data associated with your account may be deleted.

11. Disputes

11.1 If you have any concerns or believe another user has violated these terms, please contact us at . We will investigate and take appropriate action as necessary.

12. Governing Law

12.1 These terms are governed by the laws of New Zealand, and any disputes will be resolved in the courts of New Zealand.
