Terms of Use

We’re excited that you’ve chosen the Launchpad to embark on a life-changing journey. We know you’re keen to get started, but let’s run through a few house rules so you and all our Launchpad members can participate in a safe, fun environment where you know what to expect from us, and we know what to expect from you.

Please take the time to carefully read the Launchpad’s Terms of Use and Privacy Policy.

Interpretation

Agreement – means these Terms of Use and Privacy Policy

Life101 – means Life101 Limited, the company that owns and operates the Life101 Launchpad, life101.co.nz and 101launchpad.co.nz

Launchpad – means the course and learning platform owned and operated by Life101, through the website

“our, we, us” – means Life101 and any associated services

“website” – means 101launchpad.co.nz

“you” – means the party or parties using the Launchpad, who agree (expressly or impliedly) to accept the terms of the Agreement.

1. Acceptance of Terms

1.1 By accessing or using the Life101 Launchpad and any of Life101’s services, you agree to abide by the following terms of use.

a.You acknowledge that you have read, understood and agree to be bound by the Agreement.
b. Either:

i. you have the legal capacity to enter into the Agreement; or
ii. your parent or legal guardian has provided their consent to enter into this Agreement on your behalf, if you are under 18 years of age.

1.2 If you are accepting the terms of this Agreement on behalf of a third party, you warrant to us that you possess the authority to legally commit that third party to be bound by the Agreement (including obtaining parental consent if an account holder in that third party is legally considered to be a minor).

1.3 If you are accepting the terms of this Agreement as a parent or legal guardian of a Life101 Launchpad account holder who is under 18 years old, you are accepting the terms on behalf of that minor.

1.4 By utilising Life101 Launchpad, you implicitly assent to the terms of the Agreement.

1.5 In cases where a school, educational provider, youth services provider, Government entity, organisation, service or corporation has procured the services of Life101 Launchpad on your behalf, the Agreement applies to both you and to the aforementioned entity jointly and severally.

2. Revisions

2.1 We reserve the right to revise these Terms of Use at any time. Any changes will be effective immediately upon posting to the website. Your continued use of the Launchpad after such changes constitutes your acceptance of the revised Terms of Use.

3. Code of conduct

3.1 You commit to using the Launchpad responsibly and in accordance with all laws and regulations.

3.2 You will not use the Launchpad for any unlawful or unauthorised purposes.

3.3 You are to utilise the Launchpad only for the purpose of individual learning, educational support, or professional development.

3.4 You hold sole responsibility for the content stored under your personal account and agree not to provide any content that is offensive, defamatory, or infringing upon the rights of others. We reserve the right to remove any user content at any time, with or without reason.

3.5 We will not sell, rent, or share your personal information with any third party for their own marketing purposes without your consent.

4. Intellectual Property

The Launchpad may contain proprietary materials (“IP”), including but not limited to text, graphics, logos, and software, all of which are the property of Life101. You agree not to copy, alter, replicate, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or trade any such IP.

5. Modifications

We maintain the right to modify, suspend, or terminate the Launchpad and any services in part or whole, at any time.  We may also enforce limitations on specific features, partially or wholly restrict your access to the Launchpad without prior notice or accountability.

6. User Accounts

6.1 To access Launchpad services and features, you may be required to create accounts. You are responsible for maintaining the confidentiality of account information and agree to accept responsibility for all activities that occur under your account(s).

6.2 You must provide accurate, complete and updated information when creating your Launchpad account. You agree not to impersonate someone else or provide false information. You are responsible for updating the information on your account, or where necessary informing us of any changes.

7. Subscription

7.1 To subscribe to the Launchpad, you must complete the registration process and provide us with accurate and complete information.

7.2 If you have subscribed to the Launchpad, you agree to all terms of the Agreement.

7.3 If your subscription falls under an educator account or a business account, you agree to use the service only if the school, education provider, service, company or organisation has authorised you to do so.

7.4 If you are responsible for registering an educator account that is linked to other user accounts, it is your responsibility to inform us of any changes or concerns regarding Launchpad users (staff or students) associated with your educator account. You are required to notify us immediately when any accounts created under your school or education provider should be terminated.

7.5 If you are responsible for registering a business account that is linked to other user accounts, it is your responsibility to inform us of any changes or concerns regarding Launchpad users (staff or individual users) associated with your business account. You are required to notify us immediately when any accounts created under your business or organisation should be terminated.

7.6 You may not transfer your subscription to any third party, without our consent (which may be withheld for any reason).

8. Termination

8.1 We retain the right to suspend or terminate your account and access to our service at any time without cause, but in any event for reasons including:  breach of this Agreement; or if you engage in any behaviour on the Launchpad that we deem inappropriate.

8.2 If your Launchpad account is linked to an education provider or organisation, we reserve the right to remove your account upon their request.

9. Disclaimer of Warranties

9.1 The Launchpad is provided “as is” without any warranties, expressed or implied. We give no assurance that our service will constantly be available or devoid of errors.

9.2 We do not take responsibility for any damage to your computer system or computer security as a result of accessing the Launchpad.

10. Limitation of Liability

10.1 The information provided within the Launchpad is intended for educational purposes only and is not financial advice. As such, we are not liable for any actions taken by you or others based on the information contained on the Launchpad.

10.2 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your interpretation of our content or the use of the Launchpad.

11. Payment

11.1 Standard payment (excluding fully funded participants) for the use of the Launchpad must be made using the designated payment methods provided to you during the registration process.

11.2 All fees are non-refundable.

11.3 A single individual user subscription fee, whether purchased as an ‘individual’ subscription or under an educator or business account, entitles the user to 180 days access to the Launchpad platform and services.

11.4 All proceeds from the ‘Individual+ package’ will go towards covering one user subscription, plus funding another youth individual selected by the Venture Community Trust.

11.5 We use secure payment processing systems to ensure the safety of your payment information. However, we are not liable for any unauthorised access to or use of your payment information.

11.6 We reserve the right to change the fees for the Launchpad at any time.  Changes in fees will not affect the fees for participants that have already subscribed to Launchpad.

12. Funding Application and Approval

Approval of funding is subject to the terms and conditions of the funder. The decision to approve or deny funding rests solely with the funder and is not influenced by us or the organisation making the funding application.

13. Funded Participant Responsibilities

If you become a funded participant or organisation (pending funding approval as referred to at clause 12), it is your responsibility to adhere to the requirements and obligations set out by both Life101 and the organsiation overseeing the funding application.

14. Subscription Duration

14.1 A subscription to the Launchpad, whether purchased or funded as an individual parent, educator or business, entitles a paid user(s) to no more than 180 days access to the Launchpad from the date of account creation.

14.2 After the subscription period ends, access to the Launchpad and any course materials will be terminated unless you choose to renew your subscription.

14.3 You may not pause your subscription or put your subscription on hold.

15. Cancellation

You can cancel your subscription to the Launchpad at any time. If your account is cancelled, your account will be terminated and you will lose access to the platform and any Launchpad content. You will not be entitled to a refund, nor will you be entitled to the reactivation of your account without purchasing a new subscription.

16. Jurisdiction

The Agreement has been prepared in accordance with New Zealand law.  Any dispute relating to the terms of the Agreement shall be governed by the laws of New Zealand, and is subject to the jurisdiction of New Zealand Courts.

17. General

17.1 Any dispute or difference arising as to the interpretation of the Agreement or as to any matter arising under the Agreement, shall be submitted to, and settled in the first instance by good faith negotiations between you and us, but failing resolution, shall be referred to a mediator appointed by mutual agreement (or, if we cannot agree on the appointment of a mediator, a mediator appointed by the President of the New Zealand Law Society).

17.2 The failure by us to enforce any provision of the Agreement shall not be treated as a waiver of that provision, nor shall it affect our right to subsequently enforce that provision. If any provision of the Agreement shall be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

17.3 We may licence and/or assign all or any part of our rights and/or obligations under the Agreement without your consent.
